My truck was stolen and used to haul away a bank’s ATM. My truck did not have insurance and was found two days after the robbery. It was found deep in a wooded area stuck in the mud with damages and with the ATM still in the bed of the truck with no money. I had to pay over $250 with towing, impound, and winch fee to get it out of the mud.

You can sue anyone for anything. But it’s not the bank’s fault that your truck was stoeln, and it’s not their insurance company’s fault, either.
So you won’t win.

Nope, any more than the bank could sue you because your truck took their ATM. You are not responsible for what your truck was used for when it was stolen, and the bank is not responsible to you for anything. If you had insurance it would be covered, you don’t, it isn’t.

The bank did not do anything wrong.
The bank was not negligent and their negligence did not cause the damage to your truck.
If the thief is caught – you can sue the thief.
When you decide not to carry insurance on your vehicle you become “self insured”. That means you pay out of pocket for any damage to your vehicle. You made the conscious decision to be personally responsible for the damage to your vehicle. So….now you have to be personally responsible for the damage to your vehicle and pay out of pocket.

Here’s a question for you: how could an ATM machine possibly be at fault for damages to your truck? Did the ATM rip itself out of it’s foundation, take your keys from you and drive away in your truck? Maybe the bank should sue YOU for the damages done to their ATM. After all, it was your truck..

The thief is responsible to pay for damages. Sue him. You can sue the bank if you want but you will lose. If you had Insurance, it would have paid for most if not all of this.

Um, how do you figure that? Nobody at the bank stole your truck. Sorry, but if you let your insurance lapse, there is NOBODY you can claim on, unless they catch the perpetrators. Even then, I bet they have nothing, and won’t have any money coming in while in jail.
I think you are between a rock and a hard place.
