Our car insurance paid accidental death for our son but it came in trust for our son? we dont have a trust so how do we cash it?

You hire a lawyer. I’m sorry, but that is the easiest, and probably in some states the only way to do it. If you live in Illinois contact me and my father will do it for free (he is an attorney in Illinois), but any other state and I would just suggest contacting a lawyer. It becomes part of your son’s estate. It is handed through the probate process. Contact your local probate court for instructions on how to set up an estate for your son.

I take it your son was over the age of majority, then, and you weren’t direct beneficiaries? That would make the cheque part of his estate. You can deposit it in an estate trust account until the estate is settled, or the lawyer calls for it to go into escrow. However, if your son was under the age of majority, the cheque should have been payable to you.
The big question is, how old was your son?

Very Sad, my condolences to you and yours.
How old was your Son? Did he have a will ? What country/state? Those questions have to be answered before anyone can properly advise you.

I am truly sorry for your loss. I suffered the same tragedy September 2007, my son was 25. You have a difficult road ahead of you. I can’t say it gets easier to bare, the hurt is immense. As all other parents that lose a child, you’ll be in my prayers.
Since it came as a trust, your son was an adult (over 18). You’ll need to work with your bank showing that you are his soul survivors. If you’ve been with your bank a long time, they should be willing to assist with your needs, mine did. Take everything with you, birth/death certificate. They may have you sign a probate form, it’s mainly to cover them for any liability.
