State:

I’m was 12 weeks preg. & had a car accident early in the morning last week. A driver hit me causing me to rearend the car in front of me. On the same day of the accident, I went to the ER that evening with pain,cramps, and spotting. At the hospital I was told that I had a miscarriage.The ER Dr. released me home with bed rest a few mins. later after dropping the news on me. The ER dr. told me that I may have passed the fetus with out knowing it and described what I may have seen in my stool. 5 days later at my follow up Ob/GYN appt. I found out that I had a missed miscarriage (meaning the baby died and was still in my womb). My OB was furious and scheduled me for an immediate D&C surgery to remove the dead fetus.
2 days later I recieved a call from an insurance adjuster inquiring about my injuries & repairing my car. I do not want to “get rich” off our deceasded baby, but do I have grounds to sue the hospital & person who caused the car accident & if so, what is an reasonable amount?
Yes, the ER dr. did an ultrasound. I had the doppler and a transvaginal ultrasound. Which lead me to believe there was a serious problem, b/c they both took @ 35 mins. total. When I followed up with my OB dr. that ultrasound took about 8 mins. and I saw the baby very clear. There was no mistaking the baby in my womb. That is why my OB was so furious. Not to mention the fact that the ER dr. tried to make me believe the baby was out of my body, when it was clearly still there.

someone bumped the rear of vehicle, so his insurance is paynig for rental and body damage… in a meanwhile, im driving enterprise rental car. my geico insurance doesn’t cover much right now, and enterprise rep asked i get their insurance and pay $19/day in case anything happens. i said ok… b/c it’s an expensive new car.

do you think the other driver’s insurance should pay this, or should it be out of my pocket?
