My 2007 Dodge Magnum was in the body shop being repaired for a minor fender bender. I was supposed to pick up the car after my insurance paid them and I paid my deductible of $500. My car was 90% done when I last spoke to them and would have been ready in about a week. A week later I get a call from their insurance company telling me my new car was was set on fire and totaled out. Turns out they were parking it outside overnight while they were closed and somebody broke in and burned it. The shop didn’t want to release the burnt body of my car to their own insurance until they got my $500 deductible. They already had gotten paid for the work they did from my insurance and wanted my $500 ded. Their insurance paid my car off. Did I have to pay that deductible cause I feel ripped off? My car was totaled while in their possession, at no fault of mine and I missed time at work plus incurred extra rental fees. Did I have to pay them ( I did already) and if not am I entitled to my $ back?
