Yes i was involved in an accident and it involved property damage and at the hospital the officer sitied me with a failure to maintain control of my vehicle and then they took a urine sample to test for drugs and alcohol, test havan’t came back yet ! Will my insurance still pay with fullcoverage and will they drop me if i do have a DUI ?

    Most auto insurance will NOT cover any damage or liability if the vehicle operator was intoxicated. It is a standard exclusion on most policies.

    I do not know where BSherman is getting his information but I have never seen an exclusion on an automobile policy for DUI of drugs or alcohol. Allowing an insurance company to exclude this would be against the public interest, i.e. it would basically render my coverage void if I were intoxicated and result in many cases where there would be no insurance, i.e. if while intoxicated I struck a pedestrian who does not have his or her own car insurance and who did not have health insurance that pedestrian would end up with the thousands of dollars of medical bills with no way to pay them because my insurance would not cover them due to my DUI !

    As long as your driver’s license was valid at the time of the accident, your insurance policy was in force and you have enough coverage (in terms of the limit of liability), you should be fine in terms of coverage. You will only have to worry about the deductible in terms of your damage.

    In terms of the DUI itself, if you are charged with it, the costs can be significant in terms of legal fees, time lost from work, court costs and DMV fines. If you are insured by a standard insurance company such as State Farm, Travelers, Erie, etc., they will cancel your policy at the next renewal if you are convicted of DUI.
